Boston Judge Rules The deportations of the Trump era violated the rights of the first amendment
In a decision of 161 pages published on Tuesday outside the Federal Court in Boston, the judge of the United States District Court, William Young, says that the Trump administration has been abusing its power when it comes to the rights of the first amendment of non -citizens.
“Actually, he says that this is the most important case he has seen in 47 years, and I can see why,” said Matt Cameron, an immigration lawyer in Boston.
“We are not, and we should not become a nation that imprisons and sports people because we are afraid of what we have to tell ourselves,” Judge Young said in his ruling on Tuesday.
The lawyer Matt Cameron says that Tuesday’s ruling is huge for the rights of the first amendment of immigrant students who have been attacked to show support for Palestine.
“I really think this is an incredible claim of those rights, it is really encouraging to see a judge go out like this,” Cameron said.
Judge Young focused a large part of his decision on the case of Rumeysa Ozturb, the graduate student of the University of Tufts who was arrested by ICE agents in Somerville in March.
“I think it is very important in this country that everyone understands that they have the right to write an editorial and return home safely and not be arrested on the street by masked government agents,” Cameron said.
OzTurb was arrested at an ice detention center for six weeks for an opinion article that was co -author in Tufts about the war in Gaza.
Although it has been released, its case was taken to the Court in New York on Tuesday when the government presses for its arrest.
Ozturb’s lawyers say that Boston’s ruling is promising for his case after the judge said: “The effect of these specific deportation procedures continues unconstitutionally to cool freedom of expression until today.”
“It is a very important conclusion and only emphasizing and underlining how unusual these arrests are, how strange this moment is and how completely little American of what we are seeing at this time is in the broader historical sense,” Cameron said. “For a judge to say that clearly, I really think this is a decision destined to be read by all, and it should be.”
After his ruling on Tuesday, Judge Young says that there will be a hearing on the remedy, which means that the court will find a solution on how the government can advance in cases like this.
Judge Young was appointed by Republican President Ronald Reagan, and has been on the bench for almost 50 years.
